Ratemate, Inc. (“we”, “us” or “our”) is committed to protecting your personal information. The following privacy policy (“Privacy Policy”) describes the way we handle information learned about you from your interactions with us, including but not limited to your visits to our mobile application (the “App”).
PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you provide us with your information, including when you access our App, you accept the terms of this Privacy Policy and our Terms of Use and consent to our collection, use, disclosure, retention and other processing of your information as described in this Privacy Policy.
1. Information We Collect
a. Personal Information
Company collects personal information about you, which may include:
● Name
● Login information (i.e., username and password)
● Profile picture
● Telephone number
● Email address
● Year of birth
● Gender
● Approximate geographic location
● Exact geographic location, if you agree to provide us access
● Contact list, if you agree to provide us access
● Photo library, if you agree to provide us access
● Direct messages between you and other users
● Reviews, ratings, comments, and other content you submit through the App
● Lists, collections, follows, and other social activity within the App
We may collect this information when you:
• Register an account with us
• Access or use the App, including to post reviews/ratings or chat with other users
• Contact us.
Where permitted by applicable law, we may combine your personal information with other information we have collected from you. We may also combine personal information we collect from you with information we receive about you from other sources, such as our service providers and website analytics and digital advertising vendors.
b. Information Collected Automatically
In addition, information about your device’s hardware and software is automatically collected by Company when you use the App. This information may include:
● IP address
● Access times and dates
● Approximate geographic location
● Operating system type
● Browser type
● Device type and model
● Other technical information such as protocol status and substatus, bytes sent and received, and server information.
We may also collect information regarding traffic patterns and your interaction with our App and advertisements. This information is used by us for our business purposes, including for the operation and improvement of the App, for technical troubleshooting, to maintain the quality of the App, to provide general statistics regarding use of the App and to determine the effectiveness of our promotional campaigns.
We may also receive similar data from our website analytics and digital advertising vendors, online advertising networks and from social media platforms, subject to your registration and privacy settings with such third-party social media platforms, and we may share this data with such third parties.
c. Cookies and Other Information Collection Tools
Cookies
A cookie is a small file containing a string of characters that is sent to your computer when you visit a website or use an online service. When you visit the website or use the service again, the cookie allows that website or online service to recognize your browser or device. Cookies may store unique identifiers, user preferences and other information.
We may use “session cookies” or “persistent cookies.” Session cookies are temporary and expire once you close your browser or once your session ends. Persistent cookies remain on your device for much longer or until you or your browser erase them. Persistent cookies have varying durations that are dependent on their expiration date.
We may also use third-party cookies, like Google Analytics, which sets cookies on the App to help analyze how visitors use the App. Please note that information collected via third-party cookies may be shared with our website analytics and digital advertising vendors.
You can visit https://www.google.com/settings/ads to learn more about Google’s use of cookies. If you would like to opt-out from the use of your information by Google Analytics, you may use Google Analytics’ opt-out browser add-on designed for this purpose.
Web browsers allow some control of most cookies through the browser settings. To find out more about cookies, including how to manage and delete cookies, visit www.allaboutcookies.org. Some web browsers provide settings that allow a user to reject cookies or to alert a user when a cookie is placed on the user’s computer, tablet or mobile device. Most mobile devices also offer settings to reject mobile device identifiers. Although users are not required to accept cookies or mobile device identifiers, blocking or rejecting them may prevent access to some features available through the App.
Pixels / Web Beacons
A pixel or web beacons is an HTML code snippet embedded in a website or email that collects information about user behaviors and interactions with the website, mobile application or email.
We may utilize pixels/web beacons both on certain aspects of the App and in HTML-formatted email messages to you. Pixels/web beacons may be used for the purpose of, among other things, measuring the success of our marketing campaigns, compiling statistics about App usage and tracking the activities of users of the App and email recipients. For instance, we may use pixels from Google on the App to enable us to create targeted advertisements and measure the effectiveness of our advertisements. For additional information on interest-based advertising, please see the Interest-Based Advertising section below. Please note that information collected via pixels/web beacons may be shared with our website analytics and digital advertising vendors.
2. Interest Based Advertising
We may collect information about your online activities on our App to provide you with advertising about products tailored to your individual interests. We also may obtain information for this purpose from third-party websites or applications on which our advertisements are served.
You may see certain advertisements on other websites or applications because we work with advertising partners (including advertising networks) to engage in remarketing and retargeting activities. Our advertising partners allow us to target our messaging to users through demographic, interest-based and contextual means. These partners track your online activities over time and across websites and applications, including our App, by collecting information through automated means, including through the use of third-party cookies and pixels/web beacons, including the pixels/web beacons that we may utilize on the App and in our HTML-formatted email messages to you. They use this information to show you advertisements that may be tailored to your individual interests. The information our advertising partners may collect includes data about your visits to websites or applications that participate in the relevant advertising networks, such as the pages or advertisements you view and the actions you take on the websites or applications. This data collection takes place both on our App and on third-party websites or applications that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts. For example, we utilize certain of our advertising partners’ targeted advertising services to show you our advertisements on other websites or applications based on your prior visits to our App and other online activity.
Provided that a company participates in industry-developed programs designed to provide consumers choices about whether to receive targeted advertising, you may opt out of interest-based advertising generally through the Network Advertising Initiative website or by visiting http://www.aboutads.info/choices/ (web-based advertising) or http://www.aboutads.info/appchoices (for mobile advertising). Opting-out does not mean that you will stop receiving advertisements from us. It means that you still stop receiving advertisements from us that have been targeted to you based on your visits and browsing activity across websites or applications over time.
3. Mate Chat AI Assistant
Our application includes an AI-powered conversational assistant ("Mate") that helps you discover and search for movies, television shows, books, restaurants, hotels, products, and other users' ratings. Mate is not a human representative; it is an automated system that uses large language models and other artificial intelligence technologies, provided by third-party service providers, to interpret your messages and generate responses. When you use Mate, we collect the content of your messages, technical and usage information (such as device identifiers, IP address, and session identifiers), and, where you have granted device permission, your geolocation for location-based queries. Please do not submit sensitive personal information, financial details, government identifiers, health information, or information about third parties; Mate does not automatically filter such content.
Your messages and related metadata are transmitted to third-party service providers acting on our behalf, including providers of large language model inference, web and catalog search, and location lookup services; these providers process your information only at our direction and under contractual restrictions, subject to their own retention practices.
Ratemate does not persist Mate conversation history in its own databases — a short rolling window is held in memory only during your active session and discarded afterward — so no in-app history or deletion control is provided. Information collected through Mate is otherwise used and disclosed as described elsewhere in this Privacy Policy.
4. How Information is Used
We may use the information we collect for any of the following purposes:
● to provide the App to you and to improve the App;
● to create and manage your account with us;
● to operate, improve, and personalize the services we offer, and to give each user a more consistent and personalized experience when interacting with us;
● to personalize our advertising and marketing communications and to deliver promotions and offers to you that we think may interest you;
● for security, to detect fraud or illegal activities, and for archival and backup purposes in connection with the provision of the App;
● to respond to your inquiries and communicate with you;
● for our other business purposes, such as data analytics, accounting, auditing and reporting, developing new or improving our services, identifying App usage trends and determining the effectiveness of our promotional campaigns;
● as we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Privacy Policy and our Terms of Use; (v) to protect our operations; (vi) to protect our rights, privacy, safety or property, and/or that of you or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.
SMS Messaging & Phone Verification
To create and secure your Ratemate account, we may collect and use your phone number to send one-time verification codes (OTPs) via SMS.
SMS messages are sent only in response to actions initiated by you, such as creating an account, verifying your phone number, recovering your account, or completing other security-related authentication.
These SMS messages are transactional and are not used for marketing or promotional purposes. Message frequency: 1 message per signup or password reset request. Message and data rates may apply.
We do not sell or share your phone number with third parties for marketing purposes. Your phone number may be shared only with trusted service providers that help us deliver SMS verification messages and operate our services.
By providing your phone number and requesting a verification code within the Ratemate app, you consent to receive these transactional SMS messages. You can stop receiving verification messages at any time by removing your phone number from your account or discontinuing use of phone number verification features.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information sharing described in this Privacy Policy — including sharing with business partners, advertising networks, and analytics or digital advertising vendors — exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. This exclusion applies notwithstanding any other data-sharing practice described in this Privacy Policy.
You may opt out of SMS messages at any time by replying STOP to any message from us, and you may reply HELP for assistance or contact us at support@ratemate.com.
5. Disclosure of Information
We may disclose your information:
● With Third Party Service Providers Performing Services on Our Behalf. We share your personal information with our service providers to perform the functions for which we engage them. For example, we may use third parties to host the App, provide data analytics, deliver email and SMS communications, perform identity and account verification, and power AI-based and search-based features within the App.
● With Other Users. You may post reviews and ratings through the App and may chat or message with other users. Any personal information you choose to share in such reviews, ratings, or messages will be visible to other users of the App.
● With Business Partners. We may share your information with other businesses with whom we have a relationship so that they can provide you with information about products and services that may be of interest to you.
● Through Tracking Technologies. We may share information collected through tracking technologies on the App with our analytics and digital advertising vendors, including through the pixels and web beacons described above.
● For Legal Purposes. We may share information that we collect from users as needed to enforce our rights, protect our property, or protect the rights, property, or safety of others, or as needed to support external auditing, compliance, and corporate governance functions. We will disclose personal information as we deem necessary to respond to a subpoena, regulation, binding order of a data protection agency, legal process, governmental or law enforcement request, or other legal or regulatory process. We may also share personal information as required to pursue available remedies or limit damages we may sustain.
● Changes of Control. We reserve the right to transfer or assign the information that we have collected from users in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
We will require that these third parties provide the same or equal protection of your personal information as stated in this Privacy Policy.
6. Choices
a. Account Information and Deletion
You may update your account information at any time in the app's settings. You may also delete your Ratemate account at any time from Settings → Security and Account Access, or by emailing support@ratemate.com; deletion requests are processed within 30 days. We may retain certain information after deletion where required by law or for legitimate business purposes such as fraud prevention, dispute resolution, and backup integrity.
b. Marketing Communications
You can opt out of receiving promotional emails or push notifications from us at any time by adjusting your notification preferences in the App, by clicking the unsubscribe link in any marketing email, or by contacting us at support@ratemate.com. You may continue to receive transactional or service-related messages (such as account, security, or verification notifications) even after opting out of marketing communications.
7. Links to External Websites and Online Services
Our App may contain links to third-party websites and online services. Any access to and use of such third-party websites and online services is not governed by this Privacy Policy, but is instead governed by the privacy policies of those third-party websites and online services, and we are not responsible for the information practices of such third-party websites and online services.
8. Data Retention
We retain personal information for as long as your account remains active and for a reasonable period thereafter to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements. Account profile information is retained for the life of your account. Usage logs and analytics data are typically retained for up to 24 months. Information necessary for legal, tax, or fraud-prevention purposes may be retained for longer where required by applicable law.
9. Data Security
Company uses reasonable security measures designed to prevent unauthorized intrusion to the App and the alteration, acquisition or misuse of personal information. However, please note that no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. It is your responsibility to protect the security of your login information.
10. Do Not Track
Our App does not currently take any action when it receives a Do Not Track request. Do Not Track is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. 11. Children
The App is not intended for children under the age of 13, and we do not knowingly collect personal information from anyone under 13. We require users to be at least 13 years old to register an account. Users between 13 and 18 (or the age of majority in your jurisdiction, if higher), should review this Privacy Policy with a parent or legal guardian. If we become aware that we have collected personal information from a child under 13, we will delete that information promptly. Parents or guardians who believe their child has provided us with personal information may contact us at legal@ratemate.com.
12. Nevada Residents
If you are a Nevada resident, you may submit a request that we not sell any personal information we have collected about you by contacting us at legal@ratemate.com.
13. California Shine the Light
Under California Civil Code Section 1798.83, also known as California’s “Shine the Light” law, if you are a California resident, you have a right to prevent your personal information from being disclosed to third parties for those third parties’ direct marketing purposes.
